Title
Resolution authorizing the Mayor and the Director of the Department of Public Works to enter into a Highway Occupancy Agreement with the Pennsylvania Department of Transportation in connection with the construction of a new pedestrian bridge crossing over Second Avenue.
 
 
 
 
Body
Whereas, The Urban Redevelopment Authority of Pittsburgh (the "URA") has programmed federal monies for transportation enhancement activities through a process with the Pennsylvania Department of Transportation "PENNDOT"'; and
 
Whereas, the funds will support the URA on the construction phase of a proposed pedestrian bridge (the "Project") spanning from near South Water and Hot Metal Streets to the Eliza Furnace Trail and crossing Second Avenue, a state owned road located within the City of Pittsburgh; and
 
Whereas, upon the completion of the Project, the URA will dedicate and convey the bridge to the City; and
 
Whereas, in order to facilitate the grant application process, the City, as future owner of the bridge is required to enter into a Highway Occupancy Agreement with PENNDOT at this time to set forth various duties and responsibilities of the parties with respect to future construction, safety, and maintenance issues.
 
Section 1.  The Mayor and the Director of the Department of Public Works are hereby authorized to enter into a Highway Occupancy Agreement with PENNDOT in connection with the construction of a pedestrian bridge connecting Hot Metal Street to the Eliza Furnace Trail crossing over Second Avenue.  The Highway Occupancy Agreement shall be approved by the City Solicitor as to form and substance.
 
Section 2.  Any Resolution or Ordinance of part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
