Resolution authorizing the Mayor and the Director of the Department of Public Works to enter into a Lease Agreement with the Phipps Conservatory and Botanical Garden for the City facility known the Garden Center for a period of ten (10) years an annual rental fee of One Dollar ($1.00) per year, with the possibility of renewal.

WHEREAS, the mission of the PHIPPS is to inspire and educate visitors with the beauty and importance of nature and to advance sustainability and worldwide biodiversity through action and research; and
WHEREAS, the PHIPPS currently occupies certain premises located on Mellon Park Road within Mellon Park and now known as the PHIPPS Garden Center (“Garden Center”) pursuant to an existing lease with the CITY, which existing lease was originally dated on or about October 18, 1976 and amended on or about February 17, 1982 (“Existing Lease”), and is scheduled to expire on August 31, 2021; and subject to an additional amendment adding three months, on a month to month lease;
WHEREAS, the PHIPPS wishes to continue to lease the Garden Center for an additional ten (10) years; and
WHEREAS, the CITY is willing to accommodate that request, and the CITY and the PHIPPS wish to terminate the Existing Lease and replace it with a new Lease, the terms of which are set out herein.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and the Director of Public Works, on behalf of the City of Pittsburgh are hereby authorized and directed to enter into a Lease Agreement(s) with the Phipps Conservatory and Botanical Garden, in a form approved by the City Solicitor, for the Garden Center Facility for an annual rental fee of One Dollar ($1.00) per year for ten (10) years with the possibility of renewal. That Lease Agreement will be in a form approved by the City Solicitor and will contain those terms and conditions for the property of the City as the City Solicitor may require.
