Resolution vacating Gazena Way between Progress Street and Carpenter Way in the 23rd Ward, 1st Council District of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Gazena Way in the 23rd Ward, 1st Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
WHEREAS, said petition contains inter-alia, an indemnification of the City from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. That vacating Gazena Way between Progress Street and Carpenter Way:
All that certain tract or parcel of land situated in Allegheny County, the City of Pittsburgh, 23rd Ward Block 24-P and described as follows:
Beginning at a point on the Southern right of way line of Carpenter Way, also being the Northeast corner of Lot 210, Parcel 28, Tract A, thence along aforesaid Carpenter Way N 45? 54'-41.83" E 10.00' to a point;
Thence along Lot 216, Parcel 27, Tract B First and Tract B Second, S 44? 05'-16.74" E 100.00'to a point;
Thence along the Northern right of way line of Progress Street S 45? 54'-43.66" W 10.00'to a point;
Thence along Lot 210, Parcel 28, Tracts A, B, C, D, and E, N 44? 05-15'.30" W 100.00'to a point, to the point of beginning, containing 0.023 acres, more or less, in the 23rd Ward, 1st Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.
Section 2. This resolution, however, shall not take effect or be of any force or validity unless owners of all the property fronting or abutting on Gazena Way as vacated by this r...
