Title
Resolution providing for the establishment of a Neighborhood Improvement District in the western neighborhoods of Pittsburgh, to be known as the West End Home Assurance Value ("WE HAV") program, and to be administered by the West Pittsburgh Partnership.

Body
WHEREAS, pursuant to the Pennsylvania Neighborhood Improvement District Act (Act 2000-130 or the "Act"), municipal corporations are authorized to designate residential areas as neighborhood improvement districts ("NID"s); and

WHEREAS, property owners residing within the western neighborhoods of the City of Pittsburgh have presented City Council with the attached petitions supporting the establishment of an NID in their area; and

WHEREAS, the purpose of the NID is to establish the West End Home Assurance Value ("WE HAV") Program; and

WHEREAS, the West Pittsburgh Partnership is incorporated in the Commonwealth of Pennsylvania as a nonprofit community development corporation, and operates in the designated western neighborhoods; and

WHEREAS, the West Pittsburgh Partnership has formally indicated its interest to Pittsburgh City Council and to the Mayor of Pittsburgh to become the designated Neighborhood Improvement District Management Association for the WE HAV NID; and

WHEREAS, a copy of the WE HAV Plan and the date, location and time of the public hearing for receiving public comment from affected property owners have been provided to all property owners and lessees in the NID at least 30 days prior to the public hearing, and notice of the hearing has been advertised at least ten days prior thereto in a newspaper of general circulation in the City of Pittsburgh; and

WHEREAS, the City Clerk of Pittsburgh City Council has determined that less than 40% of the property owners within the WE HAV NID proposed in the final plan have filed objections within 45 days of the public hearing; and
