Title
Resolution authorizing a License and Project Agreement between the City of Pittsburgh, CMDS Enterprises, Inc. and Team Pittsburgh to perform an expansion of the Marmaduke Park Concession Stand.

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. WHEREAS, Team Pittsburgh has raised money to expand the City-owned concession stand building located on a portion of Marmaduke Park (the "Site"); and
WHEREAS, Team Pittsburgh has hired CMDS as its contractor to perform the expansion; and
WHEREAS, the City has agreed to grant CMDS a license to come upon the Site for the aforesaid purpose.
The Mayor and the Director of the Department of Public Works are hereby authorized to enter into a License and Project Agreement with CMDS and Team Pittsburgh to permit capital improvements to the Marmaduke Park Concession Stand at no cost to the City. The License and Project Agreement shall be in a form approved by the City Solicitor.
Section 2. Any Resolution or Ordinance of part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
