Title

Resolution authorizing the Mayor and the Director of the Department of Public Works, on behalf of the City of Pittsburgh, to enter into an Easement Agreement granting to the City of Pittsburgh a permanent easement and right-of-way for a sidewalk/streetscape and to Concord Sierra D.A. Shadyside.

Body

WHEREAS, Concord Sierra D.A. Shadyside, LP ("Concord") is the owner of certain property situated in the 8^th Ward of the City of Pittsburgh, Allegheny County, Pennsylvania, which was conveyed to Concord by deed dated December 26^th, 2012 and recorded on March 13, 2013 in Deed Book Volume 15126, page 526 ("Estate A"); and

WHEREAS, Estate A abuts Baum Boulevard, a state route and public right of way; and

WHEREAS, Concord is undertaking the construction of a hotel project on Estate A in the Bloomfield section of the City and will construct certain new Sidewalk/Streetscape public improvements along Baum Boulevard; and

WHEREAS, the new public improvements will encroach upon Estate A; and

WHEREAS, the City requires a sidewalk/streetscape right of way and easement over, upon, across, in and through a portion of Estate A for use by the general public; and

WHEREAS, Concord is willing to grant that permanent easement; and

WHEREAS, the City has agreed to enter into an Easement Agreement with Concord.

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1.      The Mayor and the Director of the Department of Public Works, on behalf of the City of Pittsburgh, are hereby authorized to execute an Easement Agreement granting to the City of Pittsburgh a permanent easement of approximately 0.014 acres across the edge of Concord's property abutting Baum Boulevard.  The Easement Agreement will be in the form approved by the City Solicitor and will contain those terms and conditions for the protection of the City of Pittsburgh as the Solicitor may require.
