Title
Ordinance amending the Pittsburgh Code, Title Four: Public Places and Property, Article I: Public Rights-of-Way, Chapter 416: Obstructions, by removing outdated language and / or adding specific language relative to permitting for right-of-way obstructions.

Body
WHEREAS, applicants seeking to obstruct the public right-of-way must currently comply with the City's existing permitting process, which requires inspection from the Department of Public Works; and

WHEREAS, unpermitted public right-of-way obstructions or obstructions that violate the City code pose safety hazards and may violate the requirements of the Americans with Disabilities Act (ADA), as well as possibly open the City up to legal liability; and

WHEREAS, furthermore, public rights-of-way, even when obstructed by permitted obstructions, should be made as open and accessible to all City residents as possible; and

WHEREAS, barring applicants with existing violations at their premise(s) issued by the Department of Public Works and / or the Department of Permits, Licenses, and Inspections from renewing or receiving right-of-way obstruction permits will help the City better maintain orderly right-of-way obstructions.

The Council of the City of Pittsburg hereby enacts a follows:

Section 1. Ordinance amending the Pittsburgh Code, Title Four: Public Places and Property, Article I: Public Rights-of-Way, Chapter 416: Obstructions, by removing outdated language and / or adding specific language relative to permitting for right-of-way obstructions.
