Title
An Ordinance supplementing the Pittsburgh Code, Title Six, Conduct, Article I, Regulated Rights and Actions, by amending Chapter 604.05 - Enforcement - Curfew

Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:
Section 1. Supplementing the Pittsburgh Code, Title Six, Conduct, Article I, Regulated Rights and Actions, by amending Chapter 604.05 - Enforcement - as follows:
§ 604.05 ENFORCEMENT.
(a) Violations. If a police officer or other authorized peace officer reasonably believes that a minor is violating any of the provisions of § 604.03 the officer shall:
[(1) First advise the minor that the minor is in violation of this section and instruct the minor to proceed immediately to the minor's residence without any detour or stop.
(2) If the minor refuses to proceed to their residence without detour or stop the officer is to take the minor into custody and escort them to a curfew center location.]
[(b) The officer shall not take the minor into custody if a reasonable explanation as provided for in § 604.04 is provided.]
Shall be hereby amended as follows:
(a) Violations. If a police officer or other authorized peace officer reasonably believes that a minor is violating any of the provisions of § 604.03 the officer shall:
(1) First advise the minor that the minor appears to be in violation of this section;
(2) Elicit from the minor as to why they are in violation of the ordinance;
(3) If the minor's explanation does not qualify under section 604.04 then the minor shall be deemed in violation of the ordinance and the officer is to take the minor into custody and escort them to a curfew center location;
(4) If the minor's explanation qualifies under section 604.04(a) (2), (4) or (7) the officer shall instruct the minor to proceed immediately to the minor's residence or stated destination without any detour or stop;
