Title
Resolution authorizing the Mayor and the Director of the Department of Parks to enter into a license and maintenance agreement or agreements with Carnegie Mellon University to permit the installation and maintenance of temporary art gardens in Frank Curto Park.
Body
WHEREAS, the Persephone Project seeks to recognize and promote gardening as a contemporary art form and; and
WHEREAS, the Persephone Project has proposed the donation, installation, and maintenance of four temporary art gardens in Frank Curto Park, which is owned by the City; and
WHEREAS, CMU's STUDIO for Creative Inquiry has already made resources available to encourage and support the Persephone Project, and CMU has further agreed to undertake responsibility for commitments relating to the installation and maintenance of the art gardens; and
WHEREAS, the City's Art Commission has provided its required approval for this installation; and
WHEREAS, the City now wishes to enter into a License and Maintenance Agreement to define CMU's responsibilities hereafter regarding the donation, installation and maintenance of the art gardens.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and the Director of the Department of Parks are hereby authorized to enter into a License and Maintenance Agreement or Agreements with Carnegie Mellon University to permit the installation and maintenance of art gardens in Frank Curto Park. The Agreement(s) shall be in a form approved by the City Solicitor.
