Title
Resolution authorizing the Mayor and the Director of the Department of Engineering and Construction, on behalf of the City of Pittsburgh, annually to apply to the United States Nuclear Regulatory Commission ("NRC") for renewal of the NRC Materials License No. 37-16878-02 and to pay annually to the NRC the fee imposed therefor by the NRC.

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. WHEREAS, the City Department of Engineering and Construction utilizes a nuclear gauge, located at 4501 Centre Avenue, Pittsburgh, PA 15213, for the purpose of ascertaining the density of certain construction materials; and
WHEREAS, the United States Nuclear Regulatory Commission ("NRC") requires the City to maintain and renew annually a Materials License to operate and store the nuclear gauge; and
WHEREAS, the NRC has issued to the City a Materials License No. 37-16878-02; and
WHEREAS, the fee for annual renewal of the Materials License varies annually based on factors outside the control of the Department of Engineering and Construction; and
WHEREAS, the City has a limited period of time from when it is notified by the NRC of the amount of the annual fee in which to renew the Materials License and pay the fee; and
WHEREAS, failure by the City to pay the fee in a timely manner may result in penalties imposed by the NRC including monetary fines and revocation of the Materials License;
The Mayor and the Director of the Department of Engineering and Construction, on behalf of the City of Pittsburgh, are hereby authorized annually to apply to the United States Nuclear Regulatory Commission ("NRC") for renewal of the NRC Materials License No. 37-16878-02 and to pay annually to the NRC the fee imposed therefor, at a cost not to exceed $3,000.00 annually, chargeable to and payable from Account 525500, Fund 1000, Organization 301000 421000, Sub-class 150, Budget Year 2003-2007 su...
