Title

Resolution authorizing the Mayor and the Director of the Department of Public Works, to enter into a license agreement or agreements, approved by the City Solicitor, with NORFOLK SOUTHERN RAILWAY COMPANY, a Virginia corporation, to install, maintain, operate and remove lights on the underside of the bridge structures, located specifically at 18th, 21st, 22nd, 23rd, 24th, 26th, 27th and 30th Streets on the South Side of the City in the 16th and 17th Wards.

Body

WHEREAS, certain streets, specifically 18th, 21st, 22nd, 23rd, 24th, 26th, 27th and 30th Streets  on the South Side in the 16th and 17th Wards, are in need of street lighting where said streets pass underneath  certain above-grade Railway bridges; and

WHEREAS, the Railway has agreed, upon certain conditions, to grant a license to the City for the installation, operation, maintenance and removal of street lights on the Railway bridges; and

WHEREAS, the City deems it to be in the interests of the residents of the City that the City enter into a license agreement, in a form approved by the City Solicitor;

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1.  The Mayor and the Director of the Department of Public Works are hereby authorized, on behalf of the City, to enter into a license agreement or agreements, in a form approved by the City Solicitor, with NORFOLK SOUTHERN RAILWAY COMPANY, a Virginia corporation, lessee and operator of the allocated assets of Pennsylvania Lines LLC,("Railway") wherein said  Railway will grant to  the City a license to use and occupy certain Railway-owned bridge structures over certain existing City public streets as may be necessary for the City to install, maintain, operate and remove lights on the underside of the bridge structures,  located specifically at 18th, 21st , 22nd, 23rd, 24th, 26th, 27th and 30th Streets on the South Side of Pittsburgh, in the 16th and 17th Wards.
