Title
Resolution authorizing the Mayor and the Director of the Department of Public Works to enter into a license agreement with the Friends of the Riverfront to construct and maintain a kayak rack and launch facility along the right bank of the Monongahela River at Duck Hollow.
Body
WHEREAS, Friends of the Riverfront (FOR), a community advocacy group organized as a 501(c)(3) corporation, has offered to build and maintain a canoe/kayak ramp and launch to be owned by the City and located on City property at Duck Hollow;
WHEREAS, the launch is slated for construction on riparian land owned by the City of Pittsburgh and also falling under the jurisdiction of the U.S. Army Corps of Engineers; and
WHEREAS, the City will obtain with the assistance of Friends of the Riverfront any necessary licenses/permits from the U.S. Army Corps of Engineers and the Commonwealth of Pennsylvania, Department of Environmental Protection to authorize the launch construction; and
WHEREAS, the City now seeks to enter into a License and Maintenance Agreement with the Friends of the Riverfront for construction and maintenance of both the rack and launch.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and the Director of the Department of Public Works are hereby authorized to enter into a License and Maintenance Agreement with the Friends of the Riverfront to construct and maintain a canoe/kayak rack and launch on the Monongahela River at Duck Hollow. The License and Maintenance Agreement shall permit a revocable term of ten years and shall be in a form approved by the City Solicitor.
