Resolution amending Resolution 378-2022, authorizing the Mayor and the Director of the Department of Innovation & Performance, on behalf of the City of Pittsburgh, to enter into a Fifth Amendment to Cooperation and Project Agreement for the Creation and Operation of the Regional Data Center Agreement with Allegheny County and the University of Pittsburgh, with the City and County providing funding for the University's work for the Western Pennsylvania Regional Data Center, by increasing the approved amount by Three Hundred Thousand Dollars ($300,000) for an amended total cost not-to-exceed Seven Hundred Sixty-Five Thousand Dollars ($765,000.00) each over nine years.

WHEREAS, the City and Allegheny County ("Governmental Parties"), utilizing funds granted by the Richard King Mellon Foundation, entered into that certain agreement with the University of Pittsburgh (together with the Governmental Parties, the "Parties") dated August 7, 2015, entitled "Cooperation and Project Agreement for the Creation and Operation of the Regional Data Center," (the "Agreement") under which the Governmental Parties engaged the University to develop and operate the Western Pennsylvania Regional Data Center (the "WPRDC") for a three-year period to serve as a central open data portal able to host data from the Governmental Parties and eventually from other participating local governments and other entities; and
WHEREAS, the Parties executed an Amendment to the Agreement, dated October 28, 2016 to reflect the receipt of a grant from the Heinz Endowments to be used for several purposes, including the provision of additional funds to the University for extra staffing to bring the WPRDC to full efficiency; and
WHEREAS, the Parties executed a Second Amendment to the Agreement, dated August 8, 2018, to reflect a desire to extend the agreement beyond the initial term, which was effective between August 7, 2015 and August 7, 2018, for an...
