Title
Resolution authorizing the Mayor and the Director of the Department of Public Works to enter into an easement agreement or agreements with THE BUNCHER COMPANY and others whereby THE BUNCHER COMPANY and others grant to the City an easement along Liberty Avenue, in the Second Ward of the City of Pittsburgh, for the construction on a portion of the Buncher Property of a bus stop and a pedestrian signalized crossing for use as a transit stop for the Port Authority of Allegheny County.
 
Body
WHEREAS, the BUNCHER COMPANY ("Buncher") is the owner of certain property, Block and Lot No. 9P-300, situate in the 2nd Ward, City of Pittsburgh, Allegheny County, Pennsylvania, located on Liberty Avenue, pursuant to an Indenture Agreement with Norfolk Southern Railway Company;
 
WHEREAS,  the City desires to construct and maintain a public bus stop and signalized pedestrian crossing within the property owned by Buncher; and
 
WHEREAS, Buncher is willing to grant an easement to the City for the purpose of constructing, maintaining and using the Easement Area for a public bus stop and signalized pedestrian crossing.
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      The Mayor and the Director of the Department of Public Works are authorized to enter into an easement agreement or agreements with the Buncher Company ("Buncher") and others for the grant to the City of an easement and right-of-way appropriate for construction of a public bus stop and signalized pedestrian crossing on Buncher property in the 2nd Ward identified as Lot and Block No. 9P-300, on Liberty Avenue.  A plan of the easement area is attached hereto as Exhibit "A". The Easement Agreement shall be in a form approved by the City Solicitor.
