Title
Resolution providing for an Agreement or Agreements for the grant of occupancy and access agreements with the Borough of Millvale for the purpose of right to construct a pedestrian trail bridge on Washington's Landing on the Southern end.

Body
Whereas, the Borough of Millvale is the recipient of certain funds from the Commonwealth of Pennsylvania Department of Transportation (PennDot) through its Transportation Enhancement program for the construction of a pedestrian bridge over the back channel of the Allegheny River connecting an existing riverfront trail in the Borough of Millvale with an existing riverfront trail on Washington's Landing in the City of Pittsburgh.

Whereas, Millvale is to construct the pedestrian bridge in accordance with a Plans, Specifications, and Estimate package and other related construction documents to be reviewed and approved by PennDot.

Whereas, the City of Pittsburgh holds fee simple title to all that certain piece of real property situated in the twenty fourth (24th) Ward of the City of Pittsburgh, 1st Council District of the City of Pittsburgh, County of Allegheny and Commonwealth of Pennsylvania, being known as Washington's Landing Riverfront Trail.

Whereas, Millvale desires to occupy City property for the construction and permanent placement of a bridge abutment and secure a public easement in perpetuity for pedestrian access over and across City property to access bridge and the City of Pittsburgh agrees to grant occupancy and a permanent easement given certain conditions of maintenance and continued public access set forth below;

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. The City of Pittsburgh hereby grants Millvale the right to occupy the “Project Area” situated in the 24th Ward of the City of Pittsburgh, County of Allegheny, and Commonwealth of Pennsylvania, being known as Washington's Landing Riverfront Trail (outlined o...
