WHEREAS: The City of Pittsburgh owns certain property fronting on Jacks Run Road a.k.a Farragut Street, Block 114 J, Lot 270, in the 27th Ward. This parcel also contains the unplotted cartway of realigned Farragut Street; and

WHEREAS: The Township of Ross in conjunction with the Allegheny County Sanitary Authority, Borough of Bellevue and the City of Pittsburgh Water and Sewer Authority have under taken a project in the Jacks Run water shed to improve the sanitary sewer systems along Jacks Run Road a.k.a, Farragut Street, Brighton Road and Winhurst Street; and

WHEREAS: The Township of Ross desires to obtain a permanent 20 foot wide sanitary sewer easement on a portion of City property, parcel 114-J-270, in line with the unplotted cartway on this parcel to construct a new sanitary sewer at no cost to the City of Pittsburgh.

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. The Mayor and the Director of the Department of Finance, on behalf of the City of Pittsburgh, are hereby authorized to execute an agreement with Ross Township for a permanent sanitary sewer easement, 20 feet wide, across City of Pittsburgh property, Block 114 J, Lot 270, in the 27th Ward. Said agreement shall be in form approved by the City Solicitor and shall contain such terms and conditions for the protection of the City of Pittsburgh as said Solicitor may require.
