Ordinance amending the Pittsburgh Code, Title 4 - Public Places and Property, Article I, Public Rights -of -Way, CHAPTER 416: - OBSTRUCTIONS, by adding a new section at 416.05 (a) et seq. requiring no less than a ten (10) day notice of a pending major street obstruction permit to be provided to the City Council; written notice to businesses and or residents within the impacted area; and providing for a waiver of said requirements in the event of an emergency.

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Pittsburgh Code is hereby amended at Title 4 - Public Places and Property, Article I, Public Rights -of -Way, CHAPTER 416: - OBSTRUCTIONS, by adding a new section at 416.05 (a) et seq. requiring no less than a ten (10) day notice of a pending major street obstruction permit to be provided to the City Council; written notice to businesses and or residents within the impacted area; and providing for a waiver of said requirements in the event of an emergency.
§ 416.05 - STANDARDS OF PERMIT ISSUANCE.
The Director of Public Works shall not issue any permit when the work involved will unnecessarily interfere with the flow of traffic, cause a dangerous traffic condition, not be suitable location for the type of construction for which the permit is sought, or would be detrimental to the health, welfare or safety of City residents.
(a) No less than than (10) days after receipt of an application for a Major Street Obstruction (“MSO”) permit, the Director of the Department of Public Works or, the Director's designee, shall provide written notice to the Council of the City of Pittsburgh, by way of the City Clerk, of the pending MSO permit application.
(b) Notice to Council of a Major Street Obstruction permit shall provide:
(1) name and address of the permit applicant;
(2) location and purpose for the placement of the MSO;
(3) anticipated date of the placement of the MSO;
(4) term of the MSO Permit;
