Resolution authorizing the Mayor and the Director of the Department of Mobility and Infrastructure, on behalf of the City of Pittsburgh ("City"), to enter into an agreement with Bloomfield Development Corporation ("Licensee") to provide a license, ownership and maintenance agreement for jointly-sponsored asphalt art on Friendship Ave.

WHEREAS, to facilitate pedestrian safety within the public right of way Licensee proposed installation of a mural or murals ("Artwork") on the surface of the public right away, as further depicted in Exhibit A ("Site") to assist vehicular and pedestrian traffic on Friendship Avenue along the southern side of Friendship Park; and
WHEREAS, Licensee desires to improve connection to the park and help prevent illegal parking that is detrimental to sight lines for pedestrians, cyclists, and drivers. Additionally, the focus of the artwork on natural elements will help those in the park to better understand their connection to the urban nature; and
WHEREAS, the design for Artwork was given final Approval by the City of Pittsburgh Art Commission on September 28, 2022; and
WHEREAS, City, through the Department of Mobility and Infrastructure, issued a permit authorizing Licensee to install the Artwork within the Site; and
WHEREAS, Licensee is willing to donate the Artwork and City is willing to accept the donation of the Artwork; and
WHEREAS, Licensee agrees to maintain the Artwork and Site for as long as the Artwork is permitted to exist; and
WHEREAS, City grants Licensee a non-exclusive license to maintain the Artwork within the public right of way
Be it resolved by the Council of the City of Pittsburgh as follows:
