Title
Resolution authorizing the Mayor and the Directors of the Department of General Services and the Department of Parks and Recreation to enter into a Lease Agreement with The Pittsburgh Project for Fowler Playground.
 
Body
WHEREAS, The Pittsburgh Project has offered to provide capital improvements/renovations to Fowler Playground and Fowler Pool and to operate both as a vibrant recreational space for the benefit of the general public;
 
WHEREAS, The Pittsburgh Project and the City of Pittsburgh now wish to enter into a Lease Agreement to facilitate this purpose; and
 
NOW, THEREFORE, intending to be legally bound, for and in consideration of the mutual premises hereinafter set forth, the parties hereto agree as follows:
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.      The Mayor and the Director of the Department of General Services and the Director of the Department of Parks and Recreation are hereby authorized to enter into a Lease Agreement or Agreements for Fowler Playground, Fowler Pool, and an adjacent parking lot (collectively the "Premises") with The Pittsburgh Project.  Pursuant to said Lease The Pittsburgh Project will agree to make renovations/capital improvements to the Premises for the benefit of the general public. The term of the Agreement shall be for fifteen (15) years for a rental amount of $1 per year plus utilities.  The Agreement shall be approved by the City Solicitor as to form and substance.
 
Section 2.      Any Resolution or Ordinance of part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
