Title

Resolution authorizing the Mayor and the Director of the Department of Parks to enter into a license and maintenance agreement with the Friends of the Riverfront to construct and maintain a kayak rack and launch along the left bank of the Monogahela River in Southside Riverfront Park.

 

Body

WHEREAS, Friends of the Riverfront, a community advocacy group organized as a 501(c)(3) corporation, has offered to build and maintain a canoe/kayak ramp and launch to be owned by the City and located at the City's Southside Riverfront Park; and

 

WHEREAS, the launch is slated for construction on riparian land owned by the Commonwealth of Pennsylvania and also falling under the jurisdiction of the U.S. Army Corps of Engineers; and

 

WHEREAS, the City will obtain any necessary licenses/permits from the U.S. Army Corps of Engineers and the Commonwealth of Pennsylvania, Department of Environmental Protection to authorize the launch construction; and

 

WHEREAS, the design for the rack has been approved by the City's Art Commission; and 

 

WHEREAS, the City now seeks to enter into a License and Maintenance Agreement with the Friends of the Riverfront for construction and maintenance of both the rack and launch.

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.  The Mayor and the Director of the Department of Parks are hereby authorized to enter into a License and Maintenance Agreement with the Friends of the Riverfront to construct and maintain a canoe/kayak rack and launch in Southside Riverfront Park. The License and Maintenance Agreement shall permit a revocable term of ten years and shall be in a form approved by the City Solicitor.
