Resolution vacating a portion of Milton Street at Henrietta Street in the 14th Ward, 5th Council District, of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Milton Street in the 14th Ward, 5th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and

WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. That vacating a portion of Milton Street described as follows: beginning at a point distance N. 18º 25' 33” W. A distance of 173.00 feet from the Northeasterly intersection of Henrietta Street and Milton Street to a point at the true place on beginning thence continuing along the Easterly line of said Milton Street, N 18º 25' 33” W. A distance of 77.00' to a point, said point also being monument number 60 in the Plan of Frick Park as shown on Plan in Case B, pocket 4, folder 4 in the Architecture Division of the Bureau of Transportation and Engineering; thence S. 71º 35' 07” W a distance of 50' feet to the Westerly line of Milton Street; thence S. 18º 25' 33” E., a distance of 77 feet to a point; thence N. 77º 35' 07” E. a distance of 50 feet to a point at the true place of beginning.

Containing 3, 850 Sq. Feet

Upon vacation, the entire 50' foot right-of-way portion as described above shall revert to Lot & Block 176-J-186, Schoolhouse Finance, LLC and also reserving the right of easement of a 15” combination sewer line located therein, in the 14th Ward,...
