Be it resolved by the Council of the City of Pittsburgh as follows

Whereas, in 2006, due to a lighting strike, The Carnegie Free Library was forced to close. Since then the City has struggled to maintain portions of the building, especially the roof which requires frequent maintenance. This has caused a great deal of resources such as man hours and tax payer money to be wasted in an attempt to keep this historic structure from falling into irreparable disrepair; and

Whereas, the presence of the New Hazlett Theater and their maintenance of the portion of the building that they occupy has relieved the City of the burden of maintaining the entire structure. Further the presence of The New Hazlett Theater has prevented the closure of the library from turning the building into a 'white elephant' and negatively affecting development in the area; and

Whereas, because of the future redevelopment of the library portion of the building by the Children's Museum the City wishes to take this opportunity to disinvest itself from the cost, effort, and liability of active ownership of this building, which will be accomplished with this new agreement; and

WHEREAS, the New Hazlett Theater continues to provide quality performing arts in the North Side and to the entire Pittsburgh community, and has agreed to provide two free shows to City residents each year.

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. The Mayor and the Director of Finance on behalf of the City of Pittsburgh are hereby authorized and directed to enter into a Lease Agreement(s) and/or Sub-lease Agreeme...
