Title
Resolution providing for an Agreement or Agreements for the grant of an easement to the owners of the Try Street Terminal property located on First Avenue, in the First Ward of the City of Pittsburgh, and providing for the future vacation of the northerly fifteen (15) feet of old First Avenue.

Body 
Whereas, the owners of Try Street Terminal ("Try Street"), own a certain warehouse property located on First Avenue, in the First Ward of the City of Pittsburgh ("City"), which is generally bounded by Second Avenue on the North, Try Way  on the west, the eastern boundary of Gasoline Street on the east and First Avenue on the south; and
 
Whereas, the Urban Redevelopment Authority of Pittsburgh ("URA") has acquired the southerly fifteen (15) feet of the  right-of-way known as old First Avenue (formerly Greenough Street), and the City is the owner of the northerly fifteen (15) feet of old First Avenue, which area abuts the Try Street property; and
 
Whereas, Try Street believes that an area sixty (60) feet wide south of its property, including old First Avenue, is necessary for ingress and egress to and from its property, without which its building could not be used effectively for its purposes; and
 
Whereas, Try Street further asserts that it had used the area thirty (30) feet south of old First Avenue for more than fifty (50) years, and that it had acquired title thereto by adverse possession from CSX Railroad, URA's predecessor in title; and
 
Whereas, in order to accommodate  Try Street, the City is willing to vacate the northerly fifteen (15) feet of old First Avenue, and the URA is willing to convey to Try Street the southerly fifteen (15) feet of old First Avenue; and
 
Whereas, in order  to further accommodate Try Street, the City is willing to grant to Try Street an easement for purposes of ingress and egress to and from its property over the area which is thirty (30) feet south of the southerly lin...
