Title

Resolution reserving the right of the City of Pittsburgh to pass binding ordinances regarding "program access" in accordance with the Pittsburgh Code, Chapter 425 – Cable Communications, on matters that would eliminate restraints on fair competition, thereby facilitating a competitive marketplace and the best economic advantage for the residents of the City of Pittsburgh.

 

Body

Whereas, a competitive marketplace for video products and services is in the best interest of the residents of the City of Pittsburgh, and

 

Whereas, Section 1.6C of the Franchise Agreement with AT&T points out that the City retains the right to enact "additional ordinances and regulations as the City shall find necessary," and

 

Whereas, there are no provisions in the current agreement or the Cable Communications Ordinance regarding "program access," i.e. the rights and/or ability of competing service providers to access and offer video programs and services in the Pittsburgh market.

 

Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:

 

Section 1.                     The Council of the City of Pittsburgh reserves the right to pass binding ordinances regarding "program access," in accordance with the Pittsburgh Code of Ordinances, Chapter 425, Cable Communications, on matters that would eliminate restraints on fair competition, thereby facilitating a competitive marketplace and the best economic advantage for the residents of the City of Pittsburgh.
