Title
Ordinance supplementing the Pittsburgh Code, Chapter 425 Cable Communications by requiring that the Franchisee agrees not to enter into, either directly or through affiliates or partnerships, an agreement with a programming service or broadcast station.
Body
Whereas, the City seeks to foster a competitive environment for the provision of video services by ensuring that Franchisee's competitors have non-discriminatory access to all video programming.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1 Supplementing the Pittsburgh Code, Chapter 425 Cable Communications by requiring that the Franchisee agrees not to enter into, either directly or through affiliates or partnerships, an agreement with a programming service or broadcast station.
a. the exclusive distribution or retransmission of programming by the franchisee within any area of the City;
b. a refusal by the programming service or broadcast station to negotiate in good faith a reasonable agreement to license programming on nondiscriminatory terms and conditions with a competing multichannel provider in the City; or
c. equipment, protocol, or other technical agreements that prevent or have the of preventing access to programming by a competing multichannel provider.
