Resolution authorizing the Mayor and the Director of Finance to execute an Agreement of Sale and all related documents necessary to effect the purchase by the City of Pittsburgh, in lieu of taking by eminent domain, of 410 Mathews Avenue in the 30th Ward and to accept a deed for the property. Further authorizing the expenditure of funds for the purchase, closing, and other associated auxiliary costs.

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1.
WHEREAS, the City of Pittsburgh has determined that it is in the best interests of the City and community to construct a new 4th Division for the Department of Public Works; and
WHEREAS, in lieu of taking by eminent domain, the City seeks to purchase 410 Mathews Avenue in order to allow the enhancement of the amenities for the division, to support the division and the residents; and
WHEREAS, the property owner involved has agreed to sell said property to the City; and
WHEREAS, the City wishes to enter into an agreement with the property owner in order to acquire said property.
The Mayor and the Director of the Department of Finance, on behalf of the City of Pittsburgh, are authorized to execute an Agreement of Sale and all related documents necessary to effect the purchase by the City, in lieu of taking by eminent domain, of 410 Mathews Ave in the 30th Ward of the City of Pittsburgh, County of Allegheny, Commonwealth of Pennsylvania, identified as Block and Lot Number 33-A-215; with the current property owner of said parcel, John D. Lipner and to accept a deed for the property. All documents must be approved as to form by the City Solicitor.
The purchase price, as stipulated in said Agreement of Sale, closing costs, and other associated costs (collectively the "Acquisition Costs") shall not exceed sixty-five thousand dollars ($65,000). Monies allocated for the Acquisition Costs shall be payable as follows:
