Ordinance amending the Pittsburgh City Code Title Six: Conduct, Article I: Regulated Rights and Actions, Chapter 625: Red Light Enforcement Systems.

WHEREAS, the City’s Department of Mobility and Infrastructure is collaborating with the Public Parking Authority of Pittsburgh to enforce automatic red-light enforcement; and
WHEREAS, elements of the section of City Code allowing this enforcement must be updated in order to streamline this enforcement; NOW THEREFORE,
The Council of the City of Pittsburgh hereby enacts as follows:
Section 1. The Pittsburgh Code of Ordinances, Title Six: Conduct, Article I: Regulated Rights and Actions, Chapter 625: Red Light Enforcement Systems, Section 625.07: Notification of Violation, is hereby amended as follows:
(a) The System Administrator or its designee shall prepare and mail a notice of violation addressed to the registered owner of a vehicle identified in a recorded image produced by an automated red light enforcement system as evidence of a violation of Section 3112(a)(3) of the Motor Vehicle Code and this Chapter.
(b) The notice of violation must include:
(1) The name of the registered owner of the vehicle;
(2) A copy of the recorded image showing the vehicle;
(3) The registration number and state of issuance of the vehicle registration;
(4) The date, time and place of the alleged violation;
(5) A statement that the violation charged is under Section 3112(a)(3) of Title 75 of the Pennsylvania Consolidated Statutes (The Motor Vehicle Code) and this Chapter;
(6) The penalty for the violation;
(7) A copy of the recorded image showing the vehicle;
(8) The date on which the notice was mailed;
(9) Instructions for return of the notice of violation; and
(10) The following text: "This notice shall be returned personally, by mail or by an agent duly authorized in writing, within 30 days of issuance. A hearing may be obtained upon the written request of the registered owner by scheduling via phone or internet. Fa...
