Title
Resolution authorizing the Mayor and the Director of Finance to enter into an easement agreement or agreements with Duquesne Light Company for the installation of certain wires, cable, and pad mount transformer on City-owned parcel ID 184-E-80 (Council District 5), at no cost to the City.
Body
WHEREAS, the City (“the Grantor”) is the owner in fee simple of that certain parcel of real property located in the 31st Ward of the City of Pittsburgh, County of Allegheny, Commonwealth of Pennsylvania, being identified as Parcel Tax ID No. 184-E-80 (1233 Mifflin Road, Council District 5) (the “Property”); and
WHEREAS, the City intends to construct a new Fire/Medic station upon the Property; and
WHEREAS, to facilitate the City’s construction project, Duquesne Light Company has agreed to supply electrical service to the Property; and
WHEREAS, in order to provide electrical service to the Property, Duquesne Light Company requires an easement over the Property to install certain wires, cable, and pad mount transformer; and
WHEREAS, the City has agreed to grant said easement to Duquesne Light Company to allow Duquesne Light Company to install said wires, cable, and pad mount transformer.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and the Director of Finance, on behalf of the City of Pittsburgh, are authorized to enter into an easement agreement or agreements with Duquesne Light Company for the installation, use, operation, maintenance, repair, and removal of wires, cable, and pad mount transformer on parcel ID 184-E-80.
Section 2. The easement agreement or agreements shall be in a form and substance approved by the City Solicitor.
Section 3. The area of the Easement is depicted on the drawings that are attached hereto as Exhibit A.
