Title

Resolution approving the plans and specifications for major improvements submitted by Phipps Conservatory Inc. for expansion of the front lawn and additional parcel of the leased premises pursuant to Section 3.03 of the Lease Agreement of 1993.

Body

Whereas, the City of Pittsburgh (The Landlord) and Phipps Conservatory, Inc. (The Tenant) entered into a Twenty-Nine year lease agreement, dated July 6, 1993, whereby the Landlord leased to the Tenant the Phipps Conservatory site, comprising the area outlined on the attached drawing, for the annual fee of $1.00; and

 

Whereas, the said Lease Agreement provided for a course of action on the part of both the Landlord and the Tenant in the event of major alterations, additions, improvements to the site as desired by the Tenant; and

 

Whereas, the said course of action calls for review and approval of applicable drawings and specifications by the City's Department of Engineering and Construction, as well as approval of the drawings and specifications by City Council; and

 

Whereas, the Tenant at this point in time desires to make major improvements in the area identified on the drawing as the Additional Parcel, as well as in the Front Lawn area, as outlined on drawings hereinafter listed, which are made a part of this Resolution by reference;

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.  City Council and the Director of the Department of Engineering, on behalf of Landlord City of Pittsburgh, have reviewed and do approve the plans and specifications for major improvements to the front lawn and additional parcel of the leased premises as shown on the attached map and indexed drawings.  Such plans and specifications were submitted by Tenant Phipps Conservatory, Inc. pursuant to Section 3.03 of the Lease Agreement of 1993.
