Title
Resolution providing for a Sewer Easement And Maintenance Agreement, in substantially the form attached hereto, with East Hills Limited Partnership, granting to said Partnership sanitary and storm sewer easements, and providing for maintenance thereof, in the Thirteenth Ward of the City of Pittsburgh.

Body
WHEREAS, East Hills Limited Partnership ("East Hills") is the owner of certain property in the City of Pittsburgh ("City"), designated as Lot and Block No. 231-S-10 in the Deed Registry Office of Allegheny County, Pennsylvania, upon which is situated a housing project; and

WHEREAS, the City is the owner of a parcel of land adjoining the East Hills property, upon which the City operates and maintains a public park known as East Hills Park; and

WHEREAS, a private sanitary sewer and two (2) private storm sewers traverse through both the East Hills and City properties, thereafter connecting to the Pittsburgh Water and Sewer Authority system; and

WHEREAS, East Hills has requested that the City grant to it perpetual easements for the joint use of the sewers, and East Hills shall be fully responsible for maintenance of the sewers so long as East Hills uses the easements and sewers; and

WHEREAS, the City is willing to grant the easements upon the terms and conditions set forth in the attached Agreement.

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1. The Mayor and the Director of the Department of Public Works, on behalf of the City, are hereby authorized to enter into a Sewer Easement And Maintenance Agreement with East Hills, to be approved in form and substance by the City Solicitor, providing for grants of a sanitary sewer easement and two (2) storm sewer easements to East Hills on City property in the thirteenth (13th) ward of the City, as more particularly described in the Agreement, and providing further for maintenance of said sewers by East Hills, and the...
