AFFIRMATIVE RECOMMENDATION
Title
Resolution authorizing the Mayor and the Director of the Department of Finance to execute and deliver a deed transferring a traffic island off of Liberty Avenue to the Western Pennsylvania Conservancy.
Body
WHEREAS, the CITY owns and controls that certain traffic island (the "island") located off of Liberty Avenue in the City of Pittsburgh, County of Allegheny and Commonwealth of Pennsylvania and more specifically identified in the legal description on the attached Exhibit "A"; and
WHEREAS, the CITY is by separate Resolution authorizing the vacation of the island so that it may be transferred by deed to the Western Pennsylvania Conservancy (the "WPC");
WHEREAS, the WPC has agreed to accept the transfer of said parcel subject to the terms and conditions set forth in a deed including necessary terms relating to reversions back to the City for safety, traffic, or other necessary purposes; and
WHEREAS, the WPC plans to permit, inter alia, the installation of a statue of Gene Kelly on the island for the enjoyment of the public.
Be it resolved that the Council of the City of Pittsburgh hereby enacts as follows:
Section 1. The Mayor and the Director of the Department of Finance are hereby authorized to execute and deliver a deed transferring a traffic island off of Liberty Avenue to the Western Pennsylvania Conservancy. The deed shall be in a form approved by the City Solicitor.
Section 2. This Resolution shall become effective upon the signature of the Mayor.
