Resolution authorizing the Mayor and the Director of the Department of Finance and the Director of the Department of Public Works to enter into a License Agreement with Thar Geothermal, Inc. to permit the installation of a geothermal cooling system at the City's Zone 5 Police Station.
Body
WHEREAS, Thar Geothermal Inc. ("TGI") has received a grant from the Commonwealth of Pennsylvania, Department of Environmental Protection, Office of Energy and Technology Deployment, Pennsylvania Energy Development Authority to install a 20-ton geothermal cooling system (the "System") using non-traditional coolants at a test site for a period of 18 months (the "Project"); and
WHEREAS, the City has agreed to allow TGI to install the System in and around the City's Zone 5 Police Station, located at 1401 Washington Boulevard (the "Project Site") at no cost to the City for this installation; and
WHEREAS, after the Project is completed, the City will have the option to either have the System removed or to keep it and enter into future maintenance agreements with TGI; and
WHEREAS, to facilitate this Project, the City must enter into a License Agreement with Thar Geothermal Inc at this time to permit the installation of the System and to set forth the understanding of the parties of their responsibilities during and upon completion of the 18 month Project period.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. Authorizing Mayor and the Director of the Department of Finance and the Director of Public Works to enter into a License Agreement with Thar Geothermal, Inc. to permit the installation of a geothermal cooling system at the City's Zone 5 Police Station at no cost to the City. The License Agreement shall be approved by the City Solicitor as to form and substance.
