WHEREAS, the Borough of Crafton (the "Borough") is authorized and empowered by the Pennsylvania Borough Code, 8 Pa.C.S. ?? 101 et seq. (the "Code") to exercise eminent domain powers for the erection and extension of sewage and stormwater systems; and

WHEREAS, the Borough requires a temporary construction easement and perpetual and permanent stormwater, access, maintenance, and drainage easements on, in, over, across, under, and through that certain parcel, being identified by the Allegheny County Assessment Office as Block and Lot no. 39-F-280, situate in the City of Pittsburgh, 28th Ward (the "Subject Parcel"), to enable the Borough, its successors and assigns to install, construct, place, reconstruct, replace, use, operate, modify, maintain and repair pipes, conduits, drains, and other related facilities for storm water collection, conveyance, and drainage in connection with the Broadhead Separation GROW Project involving the separation of associated stormwater and sanitary sewers (collectively the "Project"); and

WHEREAS, in the judgment of the Borough's engineers and other representatives, and in connection with other property that has been or will be acquired, the Borough requires permanent and temporary real estate interests in and to the Subject Property for the purpose of constructing infrastructure to address combined sewer overflows pursuant to the Project; and

WHEREAS, the Pennsylvania Eminent Domain Code, 26 Pa.C.S. ? 206, requires the Borough to obtain approval from the City of Pittsburgh via resolution in order to obtain necessary real property interests in the Subject Parcel by eminent domain; and
