Title

An Ordinance amending the Pittsburgh Code, Title Six: Conduct, Article I: Regulated Rights and Actions, Chapter 620: Graffiti Abatement, by adding Section 620.10 No Enforcement Areas.

Body

                     WHEREAS, Chapter 620 of the Pittsburgh Code prohibits the application of graffiti to any city-owned or non –city owned property and imposes fines on private property owners who do not take action to remove graffiti within 10 days after notification; and

                     WHEREAS, the City Administrators have, explicitly or implicitly created a "No Enforcement Area" on the Eliza Furnace Trail primarily located in City Council District 6; and

                     WHEREAS, problems with this concept include the following:  individuals have extensively applied graffiti on the Eliza Furnace Trail and adjoining walls; a confusing message is being given by the City on the graffiti problem; City Council and the members in the effected districts were never consulted; the policy of only removing obscenities and graffiti from the trail surface is absurd; individuals utilizing the trail for recreation do not enjoy the graffiti.

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.  Amending the Pittsburgh Code, Title Six: Conduct, Article I: Regulated Rights and Actions, Chapter 620: Graffiti Abatement, by adding Section 620.10 No Enforcement Areas.

 

 

§620.10 NO ENFORCEMENT AREAS

 

                     This Chapter shall be enforced throughout the City of Pittsburgh, and any "No Enforcement Areas" either implicitly or explicitly heretofore created are hereby invalidated.  City Council must approve the creation in the future of any No Enforcement Area(s).
