Resolution declaring that certain City property, as further provided herein, in Highland Park shall be dedicated to a trail easement and that certain other property be dedicated to a temporary construction easement in order to facilitate development of the Washington Boulevard Trail.

WHEREAS, The City has proposed a mixed use bicycle and pedestrian path to provide safe passage for non-motorized travel through certain City-owned property along Washington Boulevard in the neighborhood of Highland Park (“the Project”); and
WHEREAS, Formation of this bicycle and pedestrian path requires 1) the dedication of a small portion of said property as a trail easement to the public and 2) the dedication of a small portion of said property as a temporary construction easement to facilitate Project construction; and
WHEREAS, after Project completion, the public will retain the ability to use the dedicated area for non-motorized transport and other recreational travel; and
WHEREAS, therefore the City has agreed to dedicate a portion of City-owned property in the neighborhood of Highland Park to: 1) a temporary construction easement to facilitate construction of the Project and 2) a trail easement to provide that the area be used as a trail for the benefit of the public.
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. It is hereby declared that City property further described in Exhibits A (legal description) and B (“Washington Boulevard Trail Plan,”), which are attached hereto and incorporated herein, shall hereafter officially be dedicated to the ascribed purposes defined therein, namely to a trail easement and temporary construction easement.
Section 2. The Department of Mobility and Infrastructure is authorized to record this completed legislation with the Allegheny County Recorder of Deeds as memorialization of this dedication.
