Title: Resolution authorizing a License Agreement between the City and McCormack Baron Salazar, Inc. ("MBS") to permit MBS to alter the grading of a portion of City land adjacent to the Ammon Recreation Center for the purpose of facilitating the construction of the Bedford Hill Apartments Phase II Development. WHEREAS, MBS intends to construct the Bedford Hill Apartments Phase II development located adjacent to the Ammon Recreation Center in the Hill District neighborhood of the city of Pittsburgh; and WHEREAS, MBS seeks to alter the grading of a portion of land owned by the City for the purpose of facilitating the construction of the Bedford Hill Development; and WHEREAS, the City and MBS wish to enter into this License Agreement for the purpose of granting MBS permission to use certain City property for the aforesaid purpose, subject to the terms and conditions ser forth in said Agreement. Title
Resolution authorizing a License Agreement between the City and McCormack Baron Salazar, Inc. ("MBS") to permit MBS to alter the grading of a portion of City land adjacent to the Ammon Recreation Center for the purpose of facilitating the construction of the Bedford Hill Apartments Phase II Development.
 
 
WHEREAS, MBS intends to construct the Bedford Hill Apartments Phase II development located adjacent to the Ammon Recreation Center in the Hill District neighborhood of the city of Pittsburgh; and
 
WHEREAS, MBS seeks to alter the grading of a portion of land owned by the City for the purpose of facilitating the construction of the Bedford Hill Development; and
 
WHEREAS, the City and MBS wish to enter into this License Agreement for the purpose of granting MBS permission to use certain City property for the aforesaid purpose, subject to the terms and conditions ser forth in said Agreement.
 
Be it resolved by the Council of the City of Pittsburgh as follows:
 
Section 1.
 
The Mayor and the Direction of the Department of Public Works are hereby authorized to enter into a License Agreement with McCormack baron Salazar, Inc. ("MBS"), under MBS may alter the grading of a portion of City land adjacent to the Ammon Recreation Center for the purpose of facilitating the construction of the Bedford Hill Apartments Phase II Development.  MBS shall be complete all project work at no cost to the City.  The License Agreement shall be in a form and substance approved by the City Solicitor.
 
Section 2.
 
Any Resolution or Ordinance of part thereof conflicting with the provisions of this Resolution is hereby repealed so far as the same affects this Resolution.
