Title: Resolution authorizing the City of Pittsburgh (“City”) to enter into a Community Benefits Agreement with the One Hill Neighborhood Coalition (“Coalition”), the Sports and Exhibition Authority of the City of Pittsburgh and Allegheny County (“SEA”), the County of Allegheny (“County”), the Urban Redevelopment Authority of the City of Pittsburgh (“URA”), Pittsburgh Arena Real Estate Redevelopment LP (“Penguins Redevelopment”), Pittsburgh Arena Development LP (“Penguins Arena”), and Pittsburgh Arena Operating LP, (“Penguins Operating” collectively with Penguins Redevelopment and Penguins Arena, the “Penguins Entities”) (all entities collectively, “The Parties”) for the purpose of setting forth the rights and obligations of the Parties with regard to planned redevelopment of the Lower Hill Area and the construction of a new hockey arena.

Body
WHEREAS, the member organizations of the One Hill Coalition consist of a broad coalition of organizations, businesses and residents of the Hill District of the City of Pittsburgh; and

WHEREAS, the City, through its Planning Commission, has approved a master plan for the development of a New Arena Site, and will consider one or more master plans for the development of a 28-acre site adjacent to the New Arena Site (the Additional Redevelopment Area); and

WHEREAS, the Coalition and certain of its constituent member groups have filed a Notice of Appeal at Docket Number S.A. 08-173 from the decision of the Planning Commission in the Court of Common Pleas of Allegheny County; and

WHEREAS, the Parties have agreed that it is in their mutual interests to resolve the concerns of the Coalition through cooperation and settlement, rather than through litigation,
