Resolution authorizing the Director of the Department of Finance, on behalf of the City of Pittsburgh, to execute necessary documents for the transmission of a drainage easement, temporary construction easement, and utility easement to the Pennsylvania Department of Transportation (“PennDOT”) over certain parcels in the 14th Ward, in lieu of eminent domain, in order to facilitate advancement of PennDOT’s Commercial Street Bridge Replacement Project at no cost to the City.

WHEREAS, PennDOT is currently advancing a project to replace the Commercial Street Bridge
(“the Project”) within the City of Pittsburgh; and

 

WHEREAS, advancement of the project requires PennDOT to purchase certain easements over City of Pittsburgh property further identified in pertinent excerpts from the Project right-of-way plan; and

 

WHEREAS, the Director of the Department of Finance, after consultation with the Directors of the Departments of Public Works and Mobility and Infrastructure is willing to transfer these easements to PennDOT to advance the Project; and

 

WHEREAS, the City of Pittsburgh now wishes to execute the necessary documents with PennDOT in order transfer these property rights that will advance the Project which is in the interests of both the public and the City of Pittsburgh.

 

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.                     The Director of the Department of Finance, on behalf of the City of Pittsburgh, is authorized to execute necessary documents for the transmission of a drainage easement, temporary construction easement, and utility easement to the Pennsylvania Department of Transportation (“PennDOT”) over certain parcels in the 14th Ward as further identified in the right-of-way plan attached as Exhibit A, in lieu of eminent domain, in order to facilitate advancement of PennDOT’s Commercial Street Bridge Replacement Project.
