Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1.                     The Mayor, the Director of the Department of Finance and the Director of the Parks and Recreation Department on behalf of the City of Pittsburgh are authorized to accept a deed from Summerset Neighborhood Association conveying vacant land in the 14^th Ward of the City of Pittsburgh to become part of Nine Mile Run Greenway.

The property is described as follows:

ALL THAT CERTAIN LOT or piece of ground situate in the 14^th Ward of the City of Pittsburgh, County of Allegheny, and Commonwealth of Pennsylvania, being Parcel 9 - Revision No. 3 in the Revision No. 18 to Summerset at Frick Park, as same is recorded in the Office of the Department of Real Estate of Allegheny County, Pennsylvania, in Plan Book Volume 254, Page 146.

Containing 4.1022 acres of land.

Being Tax Parcel Block 129-A, Lot 162.

BEING the same property conveyed to Summerset Neighborhood Association by deed from Summerset Land Development Associates, L.P., dated May 7, 2009 and recorded May 12, 2009 in Deed Book Volume 13924, page 110.

Section 2.                     BE IT FURTHER RESOLVED, that the said conveyance shall be subject to the following terms and conditions:

A.                      ALL State and local transfer taxes, if any, shall be paid by the purchaser.

B.                      ALL proper closing charges shall be paid by the purchaser.
