Title
Resolution granting to The Community Alliance of Spring Garden-East Deutschtown (CASGED), a non-profit corporation, a license to plant and maintain landscaped plantings so that CASGED may maintain a landscaped garden and plantings beginning at the Sarah Heinz Pedestrian Bridge and extending 2,100 feet north along Route 28, in the Twenty Third Ward (23rd) Ward, Council District 1 of the City of Pittsburgh.

Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. The Mayor and the Directors of the Department of Parks and Recreation and Public Works, on behalf of the City of Pittsburgh, are hereby authorized to execute an agreement granting to CASGED a license to plant and maintain landscaped plantings beginning at the Sarah Heinz Pedestrian Bridge and extending 2,100 feet north along Route 28, in the Twenty Third Ward (23rd) Ward, Council District 1 of the City of Pittsburgh. This Agreement is exclusively for maintenance of the Route 28 plantings. By entering into that Agreement, the City neither delegates its duties nor abdicates its responsibilities for municipal improvements.
Section 2.
The license granted by the Agreement will be subject to the following terms and conditions as will be more specifically set forth in the agreement authorized by this Resolution:
a) CASGED will bear the full cost and expense of the maintenance of the landscaped garden and plantings.
b) CASGED will indemnify, save harmless, and defend the City of Pittsburgh from any and all damages or claims for damages, whether to property or to person, associated with their work.
c) CASGED will cause minimum disruption to the site and observe appropriate safety measure when accessing and working the site.
