Whereas, the City is subject to oversight by the Intergovernmental Cooperation Authority created by Act 11 of 2004; and
Whereas, the Intergovernmental Cooperation Authority is to be made up of five voting members and all members of the board must be residents of this Commonwealth and, except the Secretary of the Budget, must either be residents of the City of Pittsburgh or have their primary places of business or employment in the City; and
Whereas, ICA board member Jim Roddey publicly announced his intention to move his residency out of the City of Pittsburgh; and
Whereas, the Mayor and members of City Council have information indicating that Mr. Roddey does not have a primary place of business or employment in the City; and
Whereas, the Mayor and members of City Council believe that because of Mr. Roddey's failure to qualify as a board member, Mr. Roddey's participation as a board member of the ICA is illegal and his actions as a member of the ICA are void;

NOW THEREFORE BE IT RESOLVED THAT THE CITY SOLICITOR IMMEDIATELY:
1. Take such action as is necessary to determine whether and on what basis the status of Mr. Roddey as an ICA board member may be challenged; and
2. If warranted, prepare an appropriate action in a court of competent jurisdiction seeking Mr. Roddey's removal effective as of the date of his disqualification.
