Title

Resolution vacating a portion of S 4^th Street between E. Carson Street and Cabot Way in the 17^th Ward, 3^rd Council District, of the City of Pittsburgh.

Body

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of S. 4^th in the 17^th Ward, 3^rd Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and

WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by and persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1.  That vacating the eastern portion of S. 4^th Street between E. Carson Street and Cabot Way, 25' wide by 100' in length, adjacent to Lot and Block 3-E-74.  This is only a partial street vacation extending 25' out from Lot and Block 3-E-74 and includes the adjoining wall that fronts on Cabot Way and also reserving the right of easement of a 20" sewer line and a 8" water line located therein, in the 17^th Ward, 3^rd Council District of the City of Pittsburgh as described blow shall be and the same is hereby vacated.
