Resolution vacating portions of Zama Road in the 14th Wards, 5th Council District of the City of Pittsburgh.

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.  Whereas, it appears by the petition and affidavit on file in the Office of the City Clerk that all owners of the property fronting or abutting on the line of Zama Road in the 14th Wards, 5th Council District of the City of Pittsburgh, have petitioned the Council of the City of Pittsburgh to enact a resolution for the vacation of same, and

 

Whereas, said petition contains inter-alia, an indemnification of the City from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by any persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore

 

That vacating a portions of Zama Road:

 

                     The following is the description of the proposed location of two (2) portions of Zama Road as laid out on Park Edge Acres Plan of Lots, in the 14th Ward of the City of Pittsburgh, recorded in the office of the Recorder of Deeds in Allegheny County in Plan Book Volume 32 Pages 92 and 93 and accepted by the City of Pittsburgh Ordinance 225, approved March 26, 1927 and recorded in Ordinance Book 38, Page 429.

 

First

                     Beginning at a point at the intersection of the easterly line of Zama Road with the southerly line of Forward Avenue as laid out on the Park Edge Plan of Lots, Plan Book Volume 32, Pages 92 and 93.

 

                     Thence, along the easterly line of Zama Road as laid out on the said plans, by a line curving to the left, having a radius of 30.00 feet an arc distance of 58.52 feet to a point of compound curvature, said line having a chord of South 49º 00' 55" West a distance of 49.67 feet;

 

                     Thence, continuing along the said easterly line of Zama Road by a line curving to the left having a radius of 856.22 feet an arc distance of 204.23 feet to a point of tangency, the chord of  said line being South 13º 42' 00" East a distance of 203.75 feet;

 

                     Thence, continuing along the said easterly line, South 20º 32' 00" East a distance 85.00 feet to a point of curvature;

 

                     Thence, by a line curving to the right, having a radius of 532.90 feet, an arc distance of 272.36 feet to a point of tangency the chord of said line being South 05º 53' 30" East a distance of 269.41 feet;

 

                     Thence, continuing by the same, South 08º 45' 00" West a distance of 188.70 feet to a point of curvature;

 

                     Thence, continuing by the same, by a line curving to the right, having a radius of 210.00 feet, an arc distance of 280.08 feet to a point of tangency, the chord of said line being South 46º 57' 29" West a distance of 259.78 feet;

 

                     Thence continuing along the said easterly line of Zama Road, South 85º 10' 00" West a distance of 49.80 feet to a point at the southwesterly limit of this portion of Zama Road being vacated;

 

                     Thence, by a line crossing Zama Road as laid out on the said Park Edge Drive Plan of  Lots, North 55º 45' 27" West a distance of 63.46 feet to a point on the westerly line of Zama Road;

 

                     Thence, along the westerly line of Zama Road North 85º 10' 00" East a distance of 99.06 feet to a point of curvature;

 

                     Thence, by a line curving to the left, having a radius of 170.00 feet, an arc distance of 226.73 feet to a point of curvature of tangency the chord of said line being North 46º 57' 29" East a distance of 210.30 feet;

 

                     Thence continuing along the said westerly line of Zama Road, North 08º 45' 00" East a distance of 188.70 feet to a point of curvature;

 

                     Thence, by a line curving to the left, having a radius of 492.90 feet, an arc distance of 251.92 feet to a point of tangency, the chord of said line being North 05º 53' 30" West a distance of 249.18 feet;

 

                     Thence, North 20º 32' 00" West a distance of 85.00 feet to a point of curvature;

 

                     Thence, continuing along the said westerly line of Zama Road, by a line curving to the right having a radius of 896.22 feet, an arc distance of 213.78 feet to a point of tangency, the chord of said line being North 13º 42' 00" West a distance of 213.27 feet;

 

                     Thence, continuing along the said westerly line, North 06º 52' 00" West a distance of 15.33 feet to a point of curvature;

 

                     Thence continuing along the said westerly line of Zama Road, by a line curving to the left, having a radius of 186.94 feet; an arc distance of 109.96 feet to a portion on the South line of Forward Avenue, as laid out on the said Parcel Edge Acres Plan of Lots, and chord of said line being North 23º 43' 04" West a distance of 108.38 feet;

 

                     Thence, along the southerly line of Forward Avenue, by a line curving to the left, having a radius of 244.00 feet, an arc distance of 147.07 feet to a point at the intersection of said southerly line of Forward Avenue with the easterly line of Zama Road, the chord of said line being South 57º 50' 52" East a distance of 144.85 feet, the said intersection of the line being the place beginning.

 

Second

 

                     Beginning at a point on the easterly line of Zama Road as laid out on Park Edge Acres Plan of Lots, said point being located South 85º 10' 00" West along the easterly line of Zama Road, a distance of 47.59 feet from the south westerly line of the portion of Zama Road vacated in the above First Described;

 

                     Thence from and beginning along the easterly line of Zama Road, South 85º 10' 00" West a distance of 31.86 feet to a point of curvature;

 

                     Thence, continuing along the said easterly line, by a line curving to the right, having a radius of 1,280.00 feet, an arc distance of 40.54 feet to a point, the chord of said line being South 86º 04' 26" West a distance of 40.54 feet;

 

                     Thence by the following line through Zama Road as laid out on the said Park Edge Plan of Lots;

 

                     North 34º 14' 33" East a distance of 12.59 feet to a point on a curve;

 

                     Thence, by a line curving to the left, having a radius of 1,270.00 feet an arc distance of 32.60 feet to a point of tangency, the chord of said line being North 85º 54' 07" East a distance of 32.60 feet;

 

                     Thence, North 85º 10" 00" East a distance of 3.69 feet to a point of curvature;

 

                     Thence, by a line curving to the right having a radius of 44.69 feet an arc distance of 30.48 feet to a point on the easterly line of Zama Road, the chord of said line being South 75º 17' 44" East a distance of 29.89 feet; the said point being the point of beginning.

 

Total area of location is 46,976 square feet or 1.07 acres.

 

The existing 20" sewerline was recently abandoned through the Urban Redevelopment Authority of Pittsburgh of Nine Mile Run Redevelopment Project, in the 14th Wards, 5th Council District of the City of Pittsburgh as described below shall be the same is hereby vacated.
