Title
Resolution vacating a portion of Claybourne Street between South Negley Avenue and South Graham Avenue in the 7th Ward, 8th Council District, of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Claybourne Street in the 7th Ward, 8th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by ant persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
Be it resolved by the council of the city of pittsburgh as follows:
SECTION 1. That all certain parcel of land situate in the 7th Ward of the City of Pittsburgh, County of Allegheny, and Commonwealth of Pennsylvania being more particularly bound and described as follows and being a portion of Claybourne Street to be vacated.
Beginning at the intersection of the westerly right-of-way line of South Negley Avenue (a 50.00 foot street) with the southerly right-of-way line of Claybourne Street (a 40.00 foot street), to be vacated; thence along said southerly right-of-way line of Claybourne Street South 62° 38' 24" West, 396.87 feet to a point; thence crossing said Claybourne Street by a curve to the left having a radius of 39.00 feet with a central angle of 61° 42' 13" an arc distance of 42.00 feet, also having the chord bearing of North 27° 21' 36" West with the chord distance of 40.00 feet, to a point on the northerly right-of-way line of said Claybourne Street; thence along said northerly right-of-way line of Claybourne Street North 62° 38' 24" east. 398.90 feet to a point on the aforesaid westerly right-of-way line of South Negley Avenue; thence along said westerly right-of-way line crossing said Claybourne Street South 24° 27' 13" East, 40.06 feet to a point of beginning and also reserving the right of easement of 10' X 9' arch sewer line and a 6" water line located therein, the 7th Ward, 8th Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.
Containing 15,671 Square feet/0.3598 Acres.
SECTION 2. This resolution, however, shall not take effect or be of any force or validity unless owners of all the property fronting or abutting on Claybourne Street as vacated by this resolution, shall, within sixty days after the effective date of this resolution, pay into the Treasury of the City of Pittsburgh the sum of $115,320.00 use of the City of Pittsburgh
