Title

Ordinance supplementing the City of Pittsburgh Code, Title Two (“Fiscal”), Article V (“Special Funds”) by adding a new Chapter 232 to provide greater flexibility to the City of Pittsburgh Department of Public Safety as to the purposes for which City is permitted to spend proceeds obtained through the confiscation of narcotics and related items via asset forfeiture and deposited into the Confiscated Narcotics Proceeds Trust Fund as provided by Resolution No. 1265 of 1985.

 

Body

WHEREAS, Resolution No. 1265 of 1985 currently limits the City’s use of proceeds derived from the confiscation of narcotics and related items to expenses associated with investigations of narcotics violations; and

 

WHEREAS, the Department of Public Safety has proposed an amendment to Resolution No. 1265 of 1985 allowing for the use of proceeds derived from the confiscation of narcotics and related items to be used for any and all expenses associated with investigation of narcotics violations or any other law enforcement activities so long as such use is in accordance with applicable federal guidelines and approved in writing by the Director of the Department of Public Safety;

 

WHEREAS, the Department of the Department of Public Safety seeks to supplement the City of Pittsburgh Code in order to add a new chapter no. 232 indicating the permitted uses of monies drawn from the Confiscated Narcotics Proceeds Trust Fund.

 

Be it resolved by the Council of the City of Pittsburgh as follows:

 

Section 1.

City of Pittsburgh Code, Title Two (“Fiscal”), Article V (“Special Funds”) adding a new Chapter 232, is hereby amended and supplemented as follows:

 

ORDINANCE authorizing and directing the City Controller to create a Trust Fund, to be designated as the “Confiscated Narcotics Proceeds Trust Fund”, for the deposit of cash and proceeds derived from the confiscation of narcotics and related items, and authorizing the use of the funds deposited therein by the Department of Public Safety for any and all expenses associated with investigation of narcotics violations or any other law enforcement activities so long as such expenses are in compliance with applicable federal guidelines and approved in writing by the Director of the Department of Public Safety. The corresponding City Code section will read as follows:

 

§ 232.01.  CONFISCATED NARCOTICS PROCEEDS TRUST FUND

 

                     (a).  The Director of the Department of Public Safety is hereby authorized to establish a Trust Fund designated as the “Confiscated Narcotics Proceeds Trust Fund” from which confiscated narcotics proceeds may be used for any and all expenses associated with investigations of narcotics violations or any other law enforcement activities so long as such expenses are in compliance with federal guidelines and approved in writing by the Director of the Department of Public Safety.

 

                     (b).  The Mayor is hereby authorized to issue and the City Controller to countersign a warrant in the amount of Thirty Thousand Dollars and No Cents ($30,000.00) payable to the Director of the Department of Public Safety, chargeable to and payable from the Confiscated Narcotics Proceeds Trust Fund (CNTPF), Index Code (250761) in the Department of Public Safety for use in said Confiscated Narcotics Proceeds Imprest Fund.  The Mayor and Controller are hereby further authorized to issue and countersign additional warrants from time to time upon invoice of the Department of Public Safety to maintain a balance of Thirty Thousand Dollars and No Cents $30,000.00 in said Imprest Fund.

 

                     (c).                     Any Resolution of Ordinance or part thereof, conflicting with the provisions of this Ordinance is hereby repealed so far as the same affects this Ordinance.
