Title
Resolution vacating portions of Cassina Way, Susquehanna Street and Annan Way in the 13th Ward, 9th Council District, of the City of Pittsburgh.

WHEREAS, it appears by the petition and affidavit on file in the Office of the City Clerk that the owners of all the property fronting or abutting on the line of Cassina Way, Susquehanna Street and Annan Way in the 13th Ward, 9th Council District of the City of Pittsburgh, have petitioned the council of the City of Pittsburgh to enact a resolution for the vacation of same, and
WHEREAS, said petition contains inter-alia, an indemnification of the city from any claims and from the payment of any damages whatsoever resulting to any properties owned by the petitioners or by ant persons whatsoever, abutting or non-abutting, for or by reason of said vacation; therefore
Be it resolved by the council of the City of Pittsburgh as follows:
Section 1. That vacating portions of Cassina Way, Susquehanna Street and Annan Way as described below:
Cassina Way:
All that certain alley to be vacated, being Cassina Alley, situated in the 13th Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows: beginning at a point at the intersection of the northerly right of way line of Cassina Alley, 15.00 feet wide, and the westerly right of way line of Richland Street, 25.00 feet wide; thence from said point of beginning by the westerly right of way line of Richland Street, S 27°35'38" W a distance of 15.00 feet to a point on the southerly right of way line of Cassina Alley; thence by the southerly right of way line of Cassina Alley N 63° 07' 22" W a distance of 477.21 feet to a point on the easterly right of way line of Dunfermline Street, 20.00 feet wide; thence by the easterly right of way line of Dunfermline Street N 27° 53' 38" E a distance of 15.00 feet to a point on the northerly right of way line of said Cassina Alley; thence by the northerly right of way line of Cassina Alley S 63° 07' 22" E a distance of 477.13 feet to a point at the intersection of the northerly right of way line of said Cassina Alley and the westerly right of way line of said Richland Street, at the point of beginning. Containing an area of 7,156 square feet or 0.164 acre.
The Sewer Index Plat 174.3 and 175.4 indicates that there is a 15" sewerline on Cassina Way. The 15" sewerline can be abandoned contingent that relocation plans are filed and approved by PWSA.
Susquehanna Street:
All that certain alley to be vacated, being Susquehanna Street, situated in the 13th Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
Beginning at a point at the intersection of the northerly right of way line of Susquehanna Street, 40.00 feet wide, and the westerly right of way line of Richland Street, 25.00 feet wide; thence from said point of beginning by the westerly right of way line of Richland Street S 27° 35' 38" W a distance of 40.00 feet to a point on the southerly right of way line of Susquehanna Street; thence by the southerly right of way of Susquehanna Street N 63° 07' 22" W distance of 477.94 feet to a point on the easterly right of way line of Dunfermline Street, 20.00 feet wide; thence by the easterly right of way line of Dunfermline Street N 27° 53' 38" E a distance of 40.00 feet to a point on the northerly right of way line of said Susquehanna Street; thence by the northerly right of way line of Susquehanna Street S 63° 07' 22" E a distance of 477.73 feet to a point at the intersection of the northerly right of way line of said Susquehanna Street and the westerly right of way line of said Richland Street, at the point of beginning. Containing an area of 19,110 square feet or 0.439 acre.
The Water Index Plat 175A, 174N and 175B indicates that there is a 6" waterline on Susquehanna Street. This existing waterline should be retained.
The Sewer Index Plat 174.3 and 175.4 indicates that there is a 36" sewerline on Susquehanna Street. All existing sewerlines should be retained.
Annan Way:
All that certain alley to be vacated, being Annan Alley, situated in the 13th Ward, City of Pittsburgh, Allegheny County, Pennsylvania, more particularly bound and described as follows:
Beginning at a point at the intersection of the northerly right of way line of Annan Alley, 15.00 feet wide, and the westerly right of way line of Richland Street, 25.00 feet wide; thence from said point of beginning by the westerly right of way line of Richland Street S 27° 35'38" W a distance of 15.00 feet to a point on the southerly right of way line of Annan Alley; thence by the southerly right of way line of Annan Alley N 63° 07' 22" W a distance of 478.54 feet to a point on the easterly right of way line of Dunfermline Street, 20.00 feet wide; thence by the easterly right of way line of Dunfermline Street N 27° 53' 38" E a distance of 15.00 feet to a point on the northerly right of way line of said Annan Alley; thence by the northerly right of way line of Annan Alley S 63° 07' 22" E a distance of 478.46 feet to a point at the intersection of the northerly right of way line of said Annan Alley and the westerly right of way line of said Richland Street, at the point of beginning. Containing an area of 7,176 square feet or 0.165 acre.
The Sewer Index Plat 174.3 and 175.4 indicates that there is a 36" sewerline on Annan Way. This existing sewerline should be retained.
And also reserving the right of easement sewer lines and water lines located therein, in the 13th Ward, 9th Council District of the City of Pittsburgh as described above shall be and the same is hereby vacated.
