Resolution authorizing the Mayor and the Director of the Department of Public Works, on behalf of the City of Pittsburgh, to enter into a maintenance agreement or agreements with the Commonwealth of Pennsylvania Department of Transportation ("PennDOT") in connection with the bridge replacement and improvements by PennDOT of State Route 885 at the juncture of Forbes Avenue and the Boulevard of the Allies, said project to be known as the "Boulevard of the Allies Bridge Replacement Project".

Body

WHEREAS, PennDOT has determined that the Boulevard of the Allies Bridge Replacement Project is in the public interest and will be beneficial and advantageous to the City; and

WHEREAS, PennDOT has been responsible for the design of the Boulevard of the

Allies Bridge Replacement Project and has prepared all plans and specifications therefore; and

WHEREAS, the City has cooperated and continues to cooperate with PennDOT by providing necessary approvals of plans and specifications for facilities owned or to be owned by the City; and

WHEREAS, the Boulevard of the Allies Bridge Replacement Project work is to be performed entirely by PennDOT and PennDOT contractors; and

WHEREAS, the City has certain statutory obligations for maintenance in connection with state-owned highways;

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1.      The Mayor and the Director of the Department of Public Works, are authorized, on behalf of the City of Pittsburgh, to enter into a maintenance agreement or agreements with the Commonwealth of Pennsylvania Department of Transportation ("PennDOT") in connection with the bridge replacement and improvements by PennDOT of State Route 885 at the juncture of Forbes Avenue and the Boulevard of the Allies, known as the "Boulevard of the Allies Bridge Replacement Project".

Section 2.      The maintenance agreement or agreements entered into with PennDOT shall specifically define the work to be performed by PennDOT on City-owned facilities, the facilities to be conveyed to the City, any betterments to be made to City facilities by PennDOT, and the maintenance duties to be performed by the City.

Section 3.      The terms and conditions of the Maintenance Agreement or Agreements shall be satisfactory to the City Solicitor.
