WHEREAS, pursuant to Resolution No. 285 of 1998, effective May 29, 1998, the City entered into a Cooperation Agreement with the Pittsburgh Parks Conservancy ("PPC") dated April 10, 2000, and renewed and extended on December 11, 2011, to establish an alliance to provide infrastructure improvements, special care, and restoration for the City's four regional parks: Frick, Schenley, Highland and Riverview; and
 
WHEREAS, the City, PPC, The Pittsburgh Water and Sewer Authority ("PWSA") and The Allegheny County Sanitation Authority ("ALCOSAN") wish to restore the hydrologic and ecological health of the portion of the Panther Hollow Watershed located within Schenley Park; and
 
WHEREAS, two sites in Schenley Park: 1) Beacon/Bartlett Streets and 2) Schenley Drive have been identified for the first phase of proposed storm water pilot infrastructure interventions/best management practices through an extensive, multi-party, planning process; and   
 
WHEREAS, the PPC now desires to volunteer its services and financial assistance to assist the City with implementing the interventions at these sites (the "Project"); and
 
WHEREAS, ALCOSAN has been awarded funding from the Environmental Protection Agency to contribute to Project expenses; and
WHEREAS, PWSA has also offered to providing funding and to assist with construction procurement and management services for the Project; and
WHEREAS, the City, the PPC, ALCOSAN, and PWSA now wish to enter into a Project License Agreement or Agreements to define the scope of the services to be provided by the various parties for the Project.
 
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PITTSBURGH AS FOLLOWS:
 
SECTION 1.  Intending to be legally bound, for and in consideration of the mutual premises hereinafter set forth, the parties hereto agree as follows:
 
The Mayor and the Director of the Department of Public Works and/or the Director of the Department of Parks and Recreation are hereby authorized to enter into a Project License Agreement or Agreements with the PPC, ALCOSAN, and PWSA authorizing the performance of storm water infrastructure interventions for the first phase of renovations in the Panther Hollow Watershed in Schenley Park (the "Project"). The Project License Agreement or Agreements shall be approved by the City Solicitor as to form and substance.  The City will contribute both in-kind services (through the Department of Public Works) and funding in the amount of Sixty Thousand Dollars ($60,000.00) (the "City Funds") towards the Project.  Upon receipt of written invoice(s) from PWSA, the City is authorized to pay the City Funds to PWSA, which will use said City Funds for expenses associated with Project. City Funds will be paid from JDE Job No. 4024500013.54207.00, Park Recon RAD (2013).  Any City Funds not used for the Project will be returned to the City.
