Resolution amending Resolution No. 316, effective June 9, 2009, entitled "Resolution authorizing a Cooperation Agreement or Agreements with the Urban Redevelopment Authority of Pittsburgh in connection with URA's application for a Redevelopment Assistance Capital Program grant of up to $500,000 for the Bombardier Test Track project" by increasing the amount of the grant to $1,000,000 and changing the subgrantee and the nature of the project. (Council District 8)

Whereas, by Resolution No. 316, effective June 9, 2009, the Council of the City of Pittsburgh authorized a cooperation agreement with the Urban Redevelopment Authority of Pittsburgh ("URA") in connection with URA's application with the Commonwealth of Pennsylvania Office of the Budget (the "Commonwealth") for a $500,000 Redevelopment Assistance Capital Program ("RACP") grant for the Bombardier Test Track project (the "Project"); and
Whereas, the Commonwealth requires the City of Pittsburgh to agree to reimburse it for any expenditure of RACP funds determined by the Commonwealth to be ineligible; and
Whereas, the Commonwealth has increased the grant by $500,000 and approved a change in the nature of the project in which Carnegie Mellon University as subgrantee will construct laboratory space in two existing buildings on its campus for a facility to develop, test and prove state of the art infrastructure and transit technologies (the "Project"), all of which require an amendment to Resolution No. 316;
Be it resolved by the Council of the City of Pittsburgh as follows:
Section 1. Section 1 of Resolution No. 316, effective June 9, 2009, which currently reads as follows:
"The Mayor, on behalf of the City of Pittsburgh, is authorized to enter into Cooperation Agreement or Agreements with the Urban Redevelopment Authority of Pittsburgh, in a form approved by the City Solicitor, in which URA agrees to administer the Project and the City agrees to reimburse the Commonwealth of Pennsylvania for the Commonwealth's share of any expenditure of RACP funds for the Project found by the Commonwealth to be ineligible."
is hereby amended to read as follows:
"The Mayor, on behalf of the City of Pittsburgh, is authorized to enter into Cooperation Agreement or Agreements with the Urban Redevelopment Authority of Pittsburgh, in a form approved by the City Solicitor, in which URA agrees to administer the Project and the City agrees to reimburse the Commonwealth of Pennsylvania for its share of any expenditure of RACP funds in the amount of $1,000,000 for the Project found by the Commonwealth to be ineligible."
