Title

Resolution authorizing the Mayor and the Director of the Department of Public Works and the Director of the Department of Finance, on behalf of the City of Pittsburgh, to grant to The Peoples Natural Gas Company, LLC, a Pennsylvania Corporation located at 375 North Shore Drive, Suite 600, Pittsburgh, Pennsylvania 15212, an easement for a gas pipeline, which must be relocated from its present position due to the Heth's Run Bridge relocation project.

Body

Be it resolved by the Council of the City of Pittsburgh as follows:

Section 1.      The Mayor and the Director of the Department of Public Works and the Director of the Department of Finance, on behalf of the City of Pittsburgh, are hereby authorized to enter into a Gas Pipeline Easement Grant Agreement (the "Agreement") with The Peoples Natural Gas Company, LLC, a Pennsylvania Corporation located at 375 North Shore Drive, Suite 600, Pittsburgh, Pennsylvania 15212, for an easement on the following described land:  

FIRST PARCEL SITUATED in        Pittsburgh 10^th Ward         ,       Allegheny              County, Pennsylvania, being a tract of       42.254      acres conveyed to the City of Pittsburgh under the date of  September 20, 1966              by Ordinance 417  , Tax Map Number       82-H-1             Parcel Number             02             .

SECOND PARCEL SITUATED in         Pittsburgh 10^th Ward         ,       Allegheny       County, Pennsylvania, being a tract of       2400       square feet conveyed to the City of Pittsburgh under the date of  August 5, 1944              and recorded in the Department of Real Estate of Allegheny County in Deed Book  2805      , Page       644      , Tax Map Number       121 H             Parcel Number             61          .

The pipeline laid pursuant to this agreement is to be located within the limits of an easement of a width deemed necessary by Peoples Natural Gas Company, LLC, but in no event to exceed sixty (60) feet.  Said Easement being approximately 600 feet will run through the subject property as shown on Exhibit A, which is attached hereto.  The pipeline shall not exceed sixteen inches (16") in diameter.  In exchange for the granting of this easement, Peoples Natural Gas Company, LLC, shall pay to the City the amount of $5,330.00 as consideration upon the execution of the Agreement.  Payment is to be made to the "Treasurer, City of Pittsburgh" and funds deposited into the following account:  JDE 11101.43.43409.107000.2014.

The Agreement shall be approved by the City Solicitor as to form and substance.
